BY SUBJECT … the home screen of your my.bigtimbermedia.com account displays a Subject drop down menu (on the left side of the screen). You will only see the subjects that correlate with the eBooks you have purchased.

BY READING LEVEL … the home screen of your my.bigtimbermedia.com account displays a Reading Level drop down menu (on the left side of the screen). You will only see reading levels that correlate with the eBooks you have purchased.

BY LANGUAGE … the home screen of your my.bigtimbermedia.com account displays a Language drop down menu (on the left side of the screen). You will only see the languages that correlate with the eBooks you have purchased. Please note: each book is offered in language formats determined by the publisher.

 

ADVANCED SEARCH … you can search for titles using the ISBN, author, series name, description, ATOS level (if available) or copyright year by using the Advanced Search feature.

 

SEARCH BAR … you can search for eBooks by typing the title, partial title or key word from the title into the Search Bar on the home screen.

Please read these Terms of Service (“Terms”, “Terms of Service”) carefully before using the my.bigtimbermedia.com. website (the “Service”) operated by Big Timber Media (“us”, “we”, or “our”).

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use the Service.

The Service

The Service offers access to web-enabled ebooks on behalf of publishers and distributors. Unless explicitly stated otherwise, any new or improved features to the Service shall be provided subject to this Agreement.

We grant you a personal, non-transferable and non-exclusive right and license to use the Service. You agree that you will not copy, modify, create a derivative work of, reverse engineer, reverse assemble or otherwise attempt to discover any source code, sell, assign, sublicense, grant a security interest in or otherwise transfer any right in the Software. You agree not to modify the Software in any manner or form, or to use modified versions of the Software, including (without limitation) for obtaining unauthorized access to the Service. You agree not to access the Service by any means other than through the interface that is provided by us for use in accessing the Service.

To use the Service, you must obtain access to the Internet, either directly or through devices that access web-based content, and pay any service fees or other costs associated with such access. In addition, you must provide all equipment necessary to make such connection to the Internet, including a computer and modem or other access device.

Modification or Termination of Service

We reserve the right to at any time and from time to time to modify or temporarily discontinue the Service (or any part thereof) with or without notice, including without limitation if you breach the Terms.

All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.

Subscriptions

Some parts of the Service are billed on a subscription basis (“Subscription”) by an affiliated publisher or distributor (third party). The billing terms will be determined by the third party.

Returns

Returns of hosted eBook sales will be accepted for 90 days after fulfillment, provided the purchase does not include the downloadable PDF eBook option. In the event an order is cancelled, BTM will delete the books from the user’s account. Once fulfilled and delivered to the customer, returns will not be accepted on purchases of hosted eBooks with the downloadable PDF eBook option enabled.

Data

We collect certain data from our users. Data include all Personally Identifiable Information (PII) and other non-public information. Data include, but are not limited to, student data, location information, metadata, and user content.

We collect Data from affiliated publishers and distributors to set up administrative accounts for schools and libraries. We also collect location information for all users of the Service. We do not actively collect other Data about students, but we do allow account administrators to enter first and last names into their my.bigtimbermedia.com account on behalf of their school or library. If an administrator chooses to provide student Data into the my.bigtimbermedia.com interface, we will store it and display it when the student logs in. We will use Data only for the purpose of fulfilling its duties and providing services under this Agreement, and for improving services under this Agreement.

We collect de-identified Data of the sort that web browsers and servers typically make available, such as the browser type, language preference, referring site, and the date and time of each visitor request. Our purpose in collecting de-identified Data is to better understand how Big Timber Media’s visitors use its website. From time to time, we may release de-identified Data in the aggregate, e.g., by publishing a report on trends in the usage of its website.

We will rely on one or more subcontractors to perform services under this Agreement. We agree to share the names of these subcontractors with you upon request. All subcontractors and successor entities will be subject to the terms of this Agreement.

We will not to attempt to re-identify de-identified Data and will not transfer de-identified Data to any party unless that party agrees not to attempt reidentification.

We will ensure that all Data in our possession and in the possession of any subcontractors, or agents to which we may have transferred Data, are destroyed or transferred to the user under the direction of the administrative account holder when the Data are no longer needed for their specified purpose, at the request of the user.

Data may not be used for any purpose other than the specific purpose(s) outlined in this Agreement.

Our collection, use and sharing of Data is governed by this Agreement and any applicable laws and regulations including, in the U.S., provisions of the Family Educational Rights and Privacy Act (“FERPA”) and the Children’s Online Privacy Protection Act (“COPPA”).

Cookies

We use “cookies” to enhance your experience and gather information about visitors and visits to our websites. We use cookies to keep users logged in when they navigate to various pages during their user sessions. Cookies are also used to help us understand user preferences based on previous or current site activity, which enables us to provide you with improved services.
